Enrolled June 19th 1843 at two in the Afternoon

We whose Names are hereunto subscribed being the major part in number and value of the proprietors of and persons interested in the open and common arable fields and the open and common meadow or pasture Lands and fields in the Township of Copmanthorpe in the West Riding of the County of York intended to be divided and inclosed under and by virtue of an act of Parliament passed in the seventh year of the reign of his late Majesty King William the fourth intituled “an act for facilitating the Inclosure of open and arable fields in England and Wales” or the Known agents of such proprietors or persons present at a meeting duly called and held pursuant to the said act this day at the house of Thomas Puckering the Royal Oak Inn in the said Township for the purpose of nominating and appointing a Commissioner or Commissioners for dividing allotting and inclosing such open and common arable meadow and pasture Lands and fields Do by this writing under our hands nominate and appoint Edward Page of Beverley in the County of York Land Surveyor (not interested in the premises) to be the sole Commissioner for dividing allotting and inclosing all the open and common arable meadow or pasture Lands or fields within the said Township of Copmanthorpe

Recitals No 1 of 7th Wm 4th Chap 115
and General Inclosure Act 41st Geo3rd Chap 109 the 2nd Geo 4th Chap 23

To all to whom these present shall come I Edward Page of Beverley in the County of York Gentleman Send Greeting Whereas in and by an act of Parliament made and passed in the seventh year of the reign of his late Majesty King William the Fourth intituled An Act for facilitating the Inclosure of open and arable fields in England and Wales After reciting that there were in many parishes Townships and places in England and Wales divers open and common arable meadow and pasture Lands and fields and that the Lands of the several proprietors of the same were frequently very much intermixed and dispersed and that it would tend to the improved cultivation and occupation of all aforesaid Lands within such parishes Townships and places be otherwise advantageous to the proprietors thereof and persons interested therein if they were enabled by a General Law to divide and inclose the same And that an Act was passed in the forty first year of the reign of his late Majesty King George the third entitled an act for consolidating in one act certain provisions usually inserted in Acts of Inclosure and for facilitating the mode of proving the several facts usually required on the passing of the acts And that another act was passed in the second year of his late Majesty King George fourth intituled An Act to amend the Laws respecting the inclosing of open fields pastures Moors Commons and waste lands in England

It was enacted that from and after the passing of the now reciting Act it should be lawful for two third parts in number and value (such value to be ascertained as thereinafter mentioned) of the several persons who should be seized or possessed of or intitled in possession to or interested in possession in any rights of common or other rights in any open and common arable fields / including any untilled slips or balks therein or any open and common meadow or pasture Lands or fields in any parish Township or place known by the Metes and Bounds or occupied according to known and legal rights/ except as thereinafter provided as tenant in fee simple or in fee tail General or Special or for life or lives or by the courtesy of England or for any other Estate of or as of freehold or for years determinable on any life or lives or for any term of years whereof one hundred years should be unexpired or in the other ways and by the other persons in the same act mentioned in such manner and with such consent as was thereinafter mentioned to inclose such open and common arable meadow and pasture Lands and fields or any of them and to extinguish the right of inter commonage which should exist as well over as in respect of such Lands Provided that that no such Inclosure should take place without the consent in writing under the Hands of two third parts in number and value of the persons so seized possessed intitled or interested as aforesaid or of the Guardians Trustees Feoffees Husbands or Committees of the persons therein mentioned such value to be ascertained in manner in the said act mentioned

Provided also that no such Inclosure should take place nor should any agreement for that purpose be binding until a Public Meeting of the Proprietors and persons interested in the Lands to be inclosed should have been previously called for the purpose of taking the expediency of such Inclosure into consideration by notice under the hands of three or more of such proprietors or persons interested such notice to be affixed and advertised in manner in the said Act mentioned at least fourteen days before the said intended meeting And it was further enacted that whenever the persons whose consents were thereby rendered necessary to any such Inclosure should have consented thereto in manner in that behalf therein authorised and required it should be Lawful for the major part in number and value of the proprietors of and persons interested in the lands intended to be divided and inclosed or their known agents who might be present at a meeting to be called for that purpose to nominate and appoint in writing under their hands one or more person or persons / not interested in the premises/ to be a commissioner or commissioners for dividing allotting and inclosing and he or they was thereby empowered to divide allot and inclose all or any of the open and common arable meadow or pasture Lands and fields in any such Parish Township or place which might have been agreed to be so divided allotted and inclosed as aforesaid

And Whereas there are or previous to the meeting hereinafter mentioned were in the Township of Copmanthorpe in the west Riding of the County of York divers open and Common arable meadow and pasture Lands and fields known by Metes and bounds and occupied according to known and legal rights of which Henry Richard Wood of Hollin Hall in the parish of Ripon in the said County of York Esquire and The Reverend John Rocke of Clungerford in the County of Salop Clerk and the Reverend Robert Norgrave Pemberton of Church Stetton in the same County Clerk / as Trustees of and for the Reverend Francis Knyvett Leighton of Shrewsbury in the same County Clerk/ and divers other persons are or were owners and proprietors in which they were seized and possessed or intitled in possession to the rights of Common or other rights in manner mentioned in the said in part recited Act and such Lands are or were very much intermixed

1st Meeting held pursuant to the Act

And Whereas at a meeting duly called and held pursuant to the said in part recited Act of the seventh year of the reign of his late Majesty King William the fourth It was agreed by Two third parts in number and value of the said owners and proprietors to inclose such open and Common arable meadow and pasture Lands and fields and to extinguish the right of intercommonage which existed over as well as in respect of such lands under and by virtue of the provisions of the said in part recited Act and the Acts thereby referred to And Whereas there is or previous to the said Meeting was in the said Township of Copmanthorpe an open and Common pasture land known by Metes and Bounds and occupied according to known and by legal rights called the Moor and containing by admeasurement forty seven acres one rood and four perches in which the said Henry Richard Wood the said John Rocke and Robert Norgrave Pemberton (as such Trustees as aforesaid) John Barstow of Acomb in the west Riding of the County of York esquire and Elizabeth his wife in her right and Ann Fawcet of the same place Spinster are or were interested in different proportions that is to say the said Henry Richard Wood and the said John Rocke and Robert Norgrave Pemberton (as such trustees) having Twenty Three gates and a half each therein and the said John Barstow and Elizabeth his wife (in her right) and the said Ann Fawcet having jointly four gates therein and at the said meeting it was agreed by them or their agents to inclose such open and Common pasture Land and to extinguish the right of intercommonage which existed over and in respect of the same in the proportions aforesaid

2nd Meeting under the Act

And Whereas at another meeting duly called and held pursuant to the recited Act I the said Edward Page (not being interested in the premises) was duly nominated and appointed to be the sole commissioner for dividing allotting and inclosing the said open and common arable meadow and pasture Lands and fields and the said open and common pasture Land called the Moor and for carrying the several other purposes of the said part recited Act and the Acts thereby referred to into execution so far as the same applied to such open and and Common arable meadow and pasture Lands and fields and open and Common pasture land respectively

Qualification of Commissioner

And Whereas I the said Edward Page did take and subscribe the oath required by the said in part recited Act of the seventh year of the reign of his late Majesty King William the fourth to be taken and subscribed by a commissioner in the execution of the same Act previous to my proceeding to Act in the execution thereof and which oath is hereinto annexed

Regularity of Notices of Meetings

And Whereas I the said Edward Page did cause such Notice to be given of the time and place of any first meeting and of all other my subsequent Meetings for Executing the powers vested in me by the said in part recited Act or by the Acts thereby referred to and all such my meetings were held within the said Township of Copmanthorpe or within seven miles of the boundaries thereof

Now Know Ye that I the said Edward Page having further proceeded in the execution of the said recited Act and the Acts thereby referred to and having fully and duly weighed and Considered all and every the matters and things in and by the same Acts vested in me or left to my award Judgement and Determination and having done every other Act Matter and thing thereby required and decided necessary to be done by me previous to the execution of this my award

Do in pursuance and by force and virtue of the directions contained in the said in part recited Act or in the Acts thereby referred to and in exercise and execution thereof and of every other power and Authority in me vested or in anywise enabling me in this behalf By this Present Writing by me executed make publish and declare this my Award, Order and determination of and concerning the premises in manner following that is to say I do declare that the Total Quantity of Land contained in the said open and Common arable meadow and pasture lands and fields agreed to be divided and allotted and inclosed is four hundred and fifty acres one rood and thirty three perches in statute measure and that the total Quantity of Land contained in the said open and common pasture Land called the Moor also agreed to be divided allotted and inclosed is forty seven acres one rood and four perches in statute measure. And I do declare that I have made and signed and hereunto annexed a plan of the said open and common arable meadow and pasture lands and fields and open and common pasture lands as agreed to be divided allotted and inclosed respectively and which said Plan shall be deemed and taken as part of this my award

Carriage roads

And I have set out and appointed And I do hereby Award that there shall be one public road and Highway to be called The Acaster road of the width of twenty feet clear of the ditches on each side thereof commencing at the south end of the town Street of the Village of Copmanthorpe near a gate called Gales Gate and extending from there in an Easterly direction over and between antient Inclosures belonging to Thomas Batman Numbered 147 and 148 upon the said plan and on the north side of that part of the said open and Common arable meadow and pasture lands and fields agreed to be divided allotted and inclosed called Temple field and crossing the York and North Midland Railway in the same field to and ending at an Ancient Highway in the said Township of Copmanthorpe leading from there to the village of Acaster Malbis.

And I have set out and appointed and do hereby award that there shall be one other public Carriage Road and Highway to be called The Colton Road of the width of thirty feet clear of the ditches on each side thereof commencing at the west end of a Lane called high west field lane and extending from there in Northerly direction along the east side of that part of the said open and common arable meadow and pasture lands and fields agreed to be divided allotted and inclosed called the High West field to a gate called Ruffet gate and from thence in a westerly direction along the North side of the same field to and ending at an ancient road called the intake road in the said Township of Copmanthorpe leading to the village of Colton

And I have set out and appointed and do hereby Award that there shall be one Public Bridle Road and private Carriage road to be called the Moor Road leading from the said village of Copmanthorpe to the village of Appleton Roebuck commencing at the south end of the village of Copmanthorpe at the said gate called Gales Gate and extending from thence Southwards over the said open and Common pasture land called the Moor agreed to be divided allotted and inclosed and Crossing the said Railway to an antient Inclosure belonging to the said Henry Richard Wood Numbered 68 upon the said plan and so far of the width of thirty feet clear of the Ditches on each side thereof and extending from thence westwards but of the width of twenty five feet clear of the ditches on each side thereof until it leads into and ends at an antient road in and through an old Inclosure belonging to the said Trustees numbered 57 on the said Plan

And I have set out and appointed and do hereby award that there shall be one Private carriage road to be called Munbys Occupation road of the width of thirty feet clear of the ditches on each side thereof commencing at the South East side of the Moor road and leading in that direction across the Moor between allotments thereof hereinafter awarded to the said Henry Richard Wood and containing respectively five acres three roods and eight perches and four acres two roods and seven perches and ending at a gate called Ords Gate

And I have set out and appointed and do hereby award that there shall be One Private Carriage road to be called Hobson’s Occupation road of the width of twenty feet clear of the Ditches on each side thereof commencing at the North West side of the Moor road nearly opposite to Munby’s occupation road and extending from thence westward across the Moor between an allotment containing six acres one rood and ten perches and an allotment containing seven acres and two roods hereinafter awarded to the said Trustees and ending at an antient Inclosure belonging to William Hobson marked Numbers 35 and 66 on the said Plan

And I have set out and appointed and do hereby award that there shall be One other private Carriage road to be called Hobson’s Occupation Road South of the width of Twenty feet clear of the ditches on each side thereof commencing on the south side and near the West end of Hobson’s occupation road extending from thence southwards over the Moor into an antient Inclosure belonging to William Hobson numbered 67 on the said plan

And I have set out and appointed and do hereby award that there shall be one other private carriage Road to be called Munby’s Little occupation road of the width of twenty five feet clear of the ditches on each side thereof commencing at the south East side of the Moor road and extending from thence Eastwards across the Moor between the said allotment containing five acres three roods and eight perches and another allotment hereinafter awarded to the said Henry Richard Wood containing three acres two roods and thirty seven perches into an antient Inclosure belonging to Joseph Munby Numbered 80 upon the said Plan

And I have set out and appointed and do hereby award that there shall be One other private Carriage road to be called The Earfit Road of the width of twenty five feet clear of the ditches on each side thereof commencing at the West side of the Moor Road and extending from thence westwards over the Moor and crossing the said Railway into Earfit Lane

And I have set out and appointed and do hereby award that there shall be one other private Carriage road to be called The Temple Field occupation Road of the width of twenty five feet clear of the ditches on each side thereof commencing on the East side of the Moor road and extending from thence Eastwards across the Moor and the Temple field between allotments hereinafter awarded to the said Henry Richard Wood those on the North side containing respectively one acre three roods and fourteen perches and sixty acres and six perches and those on the Southside containing respectively three acres two roods and thirty seven perches and ten acres three roods and twenty eight perches into antient Inclosures belonging to the said Henry Richard Wood and William Hobson respectively Numbered 99, 100 and 101 upon the said plan

And I have set out and appointed and do hereby award one other private Carriage Road to be called Batmans Occupation road of the width of twenty five feet clear of the ditches on each side thereof commencing on the West side of the Moor road and extending from thence Westwards across the Moor between Allotments hereinafter awarded to the said Trustees and containing respectively two acres and eighteen perches and three acres one rood and four perches to an antient Inclosure belonging to John Batman Numbered 29 upon the said Plan and then turning Southwards along the west side of the said Allotment containing two acres and eighteen perches and ending at an antient Inclosure belonging to the said Trustees Numbered 31 upon the said Plan

And I have set out and appointed and do hereby award one other private Carriage Road to be called The High and Low West Fields Occupation Road of the width of Twenty five feet clear of the Ditches on each side thereof Occupation Road commencing at a Gate called Low West field Gate and extending from thence westwards across part of the High West field and the whole of the Lowe West field to an antient Inclosure belonging to the said Trustees Numbered 12 on the said Plan

And I have set out and appointed and do hereby award one other private Carriage road to be called The Low West Field occupation road of the width of twenty five feet clear of the ditches on each side thereof commencing at the south side and near the route of the High and Low West fields occupation Road and extending from thence Southwards across the Low West field to and into an antient Inclosure belonging to John Batman Numbered 25 upon the said plan

And I have set out appointed and do hereby Award one other private Carriage road to be called The Crosslands occupation road of the width of twenty five feet clear of the Ditches on each side thereof commencing at the east side of the Acaster road opposite to and about the centre of an antient Inclosure belonging to the said Henry Richard Wood Numbered 114 upon the said Plan and extending from thence Eastwards over the temple field to an antient Inclosure of the said Henry Richard Wood numbered 139 upon the said Plan

And I have set out and appointed and do hereby award one other private Carriage road to be called The York Field Occupation Road of the occupation road width twenty five feet clear of the ditches on each side thereof commencing at an antient Lane called York Field Lane at the South East corner of an antient Inclosure called Campey Crofts belonging to Thomas Dobson and Elizabeth his wife in her right and Mary Lee numbered 196 on the said plan and extending from thence Eastwards over that part of the said open and Common arable meadow and pasture Lands and fields agreed to be divided allotted and inclosed called the York Field and crossing the said Railway and passing between an allotment from the same field awarded to the said Henry Richard Wood containing four acres two roods and twenty six perches on the North side thereof and another allotment from the same field also awarded to him and containing nine acres two roods and thirty three perches and an old Inclosure belonging to the said Trustees marked 212 upon the said Plan on the south side thereof to and ending at a certain Gate called Moor lands gate leading into antient Inclosures belonging to the said Trustees and Henry Richard Wood respectively numbered 213 and 233 upon the said plan

And I have set out and appointed and do hereby Award one other private Carriage road to be called The Wormhills Occupation road of the width of twenty five feet clear of the ditches on each side thereof commencing at the south side of the York field occupation road and extending from thence Southwards between an allotment from same field hereinafter awarded to the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet containing three acres one rood and twenty four perches and the said Allotment from the same field containing four acres two roods and thirty six perches and then Eastwards across the said Railway to and ending at an antient Inclosure belonging to the said Henry Richard Wood Numbered 205 upon the said plan

And I have set out and appointed and do hereby award one other private Carriage Road to be called The Little Wormhills occupation road of the width twenty five feet clear of the ditches on each side thereof commencing near the south end of Wormhills occupation road adjoining the North West side of the said Railway and extending from thence Southwestwards between the said Railway and the said allotment containing three acres one rood and twenty four perches to an antient Inclosure belonging to the said Henry Richard Wood Numbered 208 upon the said Plan

Footpaths

And I have set out and appointed and do hereby award one public foot path to be called The Copmanthorpe and Bishopthorpe Foot path of the width of four feet commencing at a gate called the Town Ings Gate and leading North Eastwards along the Little Wormhills occupation road and crossing the said Railway and extending from thence over and along the south side of the said Allotment containing nine acres two roods thirty three perches to an antient foot path in and through an old Inclosure belonging to the said Trustees Numbered 211 upon the said plan

And I have set out and Appointed and do hereby Award one other public Foot path to be called The York Field Footpath of the width of four feet commencing at the end of the York Field lane at the south east corner of the said antient Inclosure called Campey croft and extending from there along the York field occupation road to the said Railway and from thence along the North West side of the said Railway to a footpath in an antient Inclosure belonging to the said Henry Richard Wood Numbered 235 upon the said plan

And I have set out and Appointed and do hereby Award one other Public Footpath to be called The Colton Footpath of the width of four feet commencing on the North West side of the Moor road and leading over the South end of an antient Inclosure belonging to William Lamb Numbered 173 upon the said plan and over the south ends of that part of the arable meadow and pasture Lands and fields agreed to be divided allotted and inclosed called Long croft and the Low West field into the said footpath in the said old Inclosure belonging to John Batman numbered 25 upon the said Plan

And I have set out and Appointed and do hereby award one other public Footpath to be called The Temple Field Foot Path of the width of four feet commencing on the south side of the acaster road and leading across the West end of an allotment of two roods and thirty seven perches from the Temple field hereinafter awarded to the said Henry Richard Wood into an antient footpath at the North West corner of an antient Inclosure belonging to him Numbered 112 on the said Plan

Drains and watercourses

And I have set out and Appointed and do hereby award one public Drain or Watercourse to be called Butts Drain commencing between antient Inclosures belonging to the said Henry Richard Wood and Thomas Dobson and Elizabeth his wife in her right and Mary Gee respectively numbered 194 and 195 upon the said Plan and extending from there East wards between Allotments to John Hobson Thomas Hobson and Elizabeth his wife (in her right) and Mary Gee and John Barstow and Elizabeth his wife (in her right) and Ann Fawcet containing respectively three acres one rood and nineteen perches two acres one rood and three perches two acres two roods and four perches and thirteen acres one rood and twenty nine perches to the Street gate flat Drain next hereinafter mentioned and from there Northwards over the said allotment to the said John Hobson to the York and Tadcaster Turnpike road

And I have set out and Appointed and do hereby award one other public Drain or Watercourse to be called Street Gate Flat Drain commencing at the west side of an allotment of fourteen acres one rood and twenty perches hereinafter awarded to Thomas Batman and extending Westwards over the said allotment to the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcett and then between the same allotment and the said other allotment to the said John Hobson and ending at the Butts Drain

And I have set out and Appointed and do hereby award one other public Drain or Watercourse to be called Crofts Drain commencing at the East side of an allotment of three acres three roods and thirteen perches in that part of the said open and common arable meadow and pasture lands and fields agreed to be divided allotted and inclosed called Havercroft hereinafter awarded to the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet and extending from thence Eastwards over an allotment of four acres and three perches hereinafter awarded to John Hobson to the south west corner of the said antient Inclosure Numbered 196 upon the said plan and from thence Southwards between Havercroft aforesaid and that part of the said open and Common arable meadow and pasture lands and fields agreed to be divided allotted and inclosed called Little croft to the said York field lane

And I have set out and appointed and do hereby award one other public Drain or Watercourse to be called The Town Ings Drain commencing at the York field occupation road at the North East Angle of an antient Inclosure belonging to the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet numbered 197 on the said Plan and extending from thence Southwards along the West side of an allotment from the said York field to the said John Barstow and Elizabeth his wife in her right and Ann Fawcet containing one acre two roods and twenty eight perches and over or between antient Inclosures belonging to the said Henry Richard Wood and Numbered 199, 202, 200 and 201 upon the said plan to the southeast angle of the said antient Inclosure numbered 200 and from thence in an Easterly direction over or between the said antient Inclosure numbered 201 and another antient Inclosure belonging to him Numbered153 upon the said plan and passing by a Tunnel under the said Railway through and between antient inclosed lands on the North Numbered 204, 205, 206, 207 and 208 upon the said plan belonging to the said Henry Richard Wood other antient inclosed Lands numbered 209 and 216 upon the said plan belonging to the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet and other antient inclosed lands Numbered 217 and 218 upon the said Plan belonging to the said William Hobson and on the south by antient inclosed lands numbered 142, 141, 140, 139 and 135 upon the said plan belonging to the said Henry Richard Wood and another antient Inclosure numbered 134 upon the said plan belonging to the said William Hobson into an antient Rivulet or Watercourse called the Foss running between the said Townships of Copmanthorpe and Bishopthorpe

And I have set out and appointed and do hereby award one other public Drain or Watercourse to be called Short Moor Grips Drain commencing at the East end of a Tunnel under the said Railway at the south west Angle of the said Allotment from the York field containing nine acres two roods and thirty three perches and extending from thence Eastwards on the south side of the same Allotment and over antient inclosed Lands to the North East Angle of an antient inclosure belonging to the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet Numbered 215 on the said plan and from thence Southwards over other antient Inclosed Lands to and into the Town Ings Drain at the South East Angle of the said antient Inclosure belonging to them numbered 216 on the said Plan

And I have set out and appointed and do hereby Award one other public Drain or Watercourse to be called Sandhills Drain commencing at the East end of a Tunnel under the said Railway at the West side of the said Allotment from the York Field to the said Henry Richard Wood containing four acres two roods and thirty six perches and extending from thence Southwards along the East side of the said Railway to the south west Angle of the same Allotment and from thence Eastwards along the North side of the York field occupation road to an antient Inclosure belonging to the said Henry Richard Wood numbered 233 on the said Plan and from thence in the same direction over antient Inclosed lands to the North East angle of the said antient Inclosure belonging to the said Trustees Numbered 213 on the said Plan and from thence Southwards over antient inclosed lands to and into the short Moor Grips Drain at the south East Angle of an antient Inclosure belonging to the said Trustees Numbered 214 on the said plan

And I have set out and appointed and do hereby award one other public Drain or Watercourse to be called Barsteads Drain commencing in the said Temple field at the south west Angle of the said antient inclosure belonging to the said Henry Richard Wood Numbered 112 on the said plan and extending over the whole of the south end of the same antient Inclosure and from Southwards to the North East Angle of the said antient Inclosure belonging to the said Henry Richard Wood Numbered 101 upon the said plan and from thence over antient inclosed Lands in a South westerly direction to the north west angle of an antient Inclosure belonging to Martin Burnell Numbered 106 on the said Plan and from thence over antient inclosed lands in a Southwardly direction to the said antient Rivulet or Watercourse called the Foss at the south East angle of an antient Inclosure belonging to Benjamin Burnell numbered 104 on the said Plan

And I have set out and appointed and do hereby award one other Public Drain or Watercourse to be called Breck Flat Drain commencing in the Temple Field at the North East Angle of the said antient Inclosure belonging to William Hobson numbered 99 on the said plan and extending from thence over antient inclosed lands first in a South Easterly direction to the south East angle of an antient Inclosure belonging to the said William Hobson numbered 97 on the said Plan and from thence in an Easterly direction to the North east angle of an antient inclosure belonging to the said Trustees numbered 96 on the said Plan and from thence in a south Easterly direction to the said antient Rivulet or Watercourse called the Foss at the south East angle of the same antient Inclosure

And I have set out and appointed and do hereby award one other public Drain or Watercourse to be called Allans Drain commencing at the east end of an allotment from the Temple field containing one acre one rood and twenty seven perches hereinafter awarded to Matthew Allan and extending from thence Eastwards over an allotment from the same field containing two acres three roods and twenty nine perches hereinafter awarded to William Johnson to and into the Drain or Ditch on the North West side of the said Railway

And I have set out and appointed and do hereby award one other public Drain or Watercourse to be called Near Moor Drain commencing at the East side of the said antient Inclosure belonging to John Batman numbered 29 on the said Plan and extending from thence Eastwards under occupation road and over the said Allotment from the Moor to the said Trustees containing two acres and eighteen perches to and into the said Drain or Ditch on the North West side of the said Railway

And I have set out and appointed and do hereby award one other public Drain or Watercourse to be called Leighton and Woods Moor Drain commencing at the East side of the said antient Inclosure belonging to William Hobson numbered 35 upon the said plan and extending from thence Eastwards over the said allotment from the said Moor to the said Trustees containing six acres one rood and ten perches and passing under the said Moor road and continuing Southwards from thence on the East side of the same road and then in a south Easterly direction on the North side of Munbys occupation road to and into the Moor Drain near the said Gate called ords gate

And I have set out and appointed And do hereby award one other public Drain or Watercourse to be called Hobson’s Moor Drain commencing at the North East angle of the said antient Inclosure belonging to William Hobson numbered 67 upon the said plan and extending from thence Eastwards over the said allotment to the said Trustees containing seven acres and two roods to the Moor road and from thence Northwards on the west side of the Moor road to and into Leighton and Woods Moor Drain

And I have set out and appointed and do hereby award one other public Drain or Watercourse to be called Far Moor Drain commencing near the south East angle of the said antient Inclosure belonging to William Hobson Numbered 66 on the said Plan and extending from thence Eastwards and then southwards over the said allotment of seven acres and two roods and under the Moor road to and into ma Ditch dividing antient Inclosures belonging to the said Henry Richard Wood Numbered 55 and sixty eight on the said Plan

And I have set out and appointed and do hereby award one other public Drain or Watercourse to be called High and Low West Fields Drain commencing at the south end of the Town Street of Copmanthorpe at acaster road Drain and extending from thence in a North Westerly direction over the North end of the said antient Inclosure belonging to William Lamb Numbered 173 on the said plan over Long croft and over an allotment of fifty three acres and thirty four perches in Low West field hereinafter awarded to the said Trustees and under the high and Low West fields Occupation road and from thence Westwards on the North side of the same road into the said allotment of two roods and seventeen perches to the said Trustees and from thence Southwards again crossing the said high and Low West fields occupation road and over an allotment from the said Low West Field of sixty four acres one rood and thirty perches hereinafter awarded to the same Trustees to and into the Low West field Drain next hereinafter mentioned at the North East angle of the said antient Inclosure belonging to John Batman numbered 14 upon the said plan

And I have set out and appointed and do hereby Award one other public Drain or Watercourse to be called Low West Field Drain commencing on the south side of the said Low West fields at the North West Angle of an antient Inclosure belonging to Thomas Batman numbered 28 upon the said plan and extending from thence in a Westerly direction between the Low West field and antient inclosed Lands to the south east angle of an antient inclosure belonging to the said Trustees numbered 13 on the said Plan and from thence over antient inclosed lands first Westwards to the North West angle of the said antient Inclosure belonging to John Batman Numbered 14 on the said plan and from thence Southwards and Westwards to and into the said antient Rivulet or Watercourse called the Foss at the south west angle of an antient Inclosure belonging to John Batman numbered 15 on the said plan

Repairs of Private Carriage roads Drains etc

And I do order and direct that the proprietors of the open and common arable meadow and pasture Lands and fields and of the open and common pasture Lands agreed to be divided allotted and inclosed respectively shall on the Twenty fifth day of March in every year or upon the day following when the same happens to be Sunday or Good Friday appoint two proper persons being inhabitants of the said Township of Copmanthorpe and interested in the lands agreed to be divided allotted and inclosed as surveyors of the private Carriage roads and public Drains to take the Management and superintend the repairs of the private carriage roads and public Drains hereinbefore set out appointed and awarded and the fence on the North side of the said High West field adjoining the Township of Askham Bryan which persons so appointed as surveyors shall once at least every year between the first day of October and the first day of December cause to properly and sufficiently weeded cleansed scoured widened and deepened the whole of the same public Drains and cause the same Drains to be kept of sufficient Depth and other dimensions so that they may be capable of effectually draining the whole of the lands the waters whereof are or are to be conveyed by such drains respectively and that such surveyors shall from time to time keep and maintain all the private carriage roads hereinbefore set out and appointed and awarded in good and sufficient repair and condition and also from time to time keep and maintain all the Bridges over the said Drains and the Holdstocks and Tunnels under the said roads in such repair and condition that the waters of the said Drains may not be impeded and also that such surveyors shall from time to time maintain and repair and keep in good condition the said fence on the North side of the said High West field adjoining the Township ofAskham Bryan

Grass and herbage

And I do order and direct that the Grass and Herbage growing on each side of the said private carriage roads shall in each and every year be let by the said Surveyors to any person or persons who shall be willing to take the same and at the best rent or rents which can be obtained for the same and that the money arising therefrom shall be laid out and expended towards the repairs of the said private carriage roads and Public Drains and of the Bridges Holdstocks and Tunnels thereof and in the repairs of the said fence adjoining the Township of Askham Bryan

Further sums wanted how to be raised

And I do Order and direct that such further sum or sums of money as may be from time to time required for maintaining and keeping in repair the said private carriage roads public Drains Bridges Holdstocks and Tunnels and the said fence in the said High West field shall be borne and paid by the proprietors of the said open and common arable meadow and pasture lands and fields and the said open and common pasture land agreed to be divided allotted and inclosed and from time to time paid by them to such Surveyors as aforesaid in the following proportions that is to say

Allotments

And I do set out Allot and award unto the said Henry Richard Wood as Lessee for lives of the Glebe under the Dean and Chapter of the Cathedral and Metropolitical Church of Saint Peter of York an allotment from the said High West field containing sixteen acres three roods and fifteen perches bounded on or towards the East by an allotment of twenty nine acres three roods and thirty five perches hereinafter awarded to John Batman on or towards the West by an allotment of twelve acres three roods and eight perches hereinafter awarded to the said John Rocke and Robert Norgrave Pemberton (as such Trustees as aforesaid)or towards the North by the Colton road and on or towards the south by the three several allotments next hereinafter awarded to the said Henry Richard Wood in exchange as such Lessee of the Glebe as aforesaid And I do Order direct and appoint that the owner or owners for the time being of the said allotment of sixteen acres three roods and fifteen perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the East and north sides thereof And I do declare and direct that the same allotment is so awarded to the said Henry Richard Wood and shall be and be considered to be in lieu of and in compensation and full satisfaction for all the right and interest and rights and interests of him the Henry Richard Wood in to or out of or over upon or for or in respect of the said open and common arable meadow and pasture lands and fields agreed to be divided allotted and inclosed as such Lessee of the Glebe as aforesaid

‘‘‘And I do set out allot and award’’’ unto the said Trustees another allotment from the said High and Low West fields containing thirty two perches bounded on or towards the East by the allotment next hereinafter awarded to the said Trustees on or towards the West and North by the said allotments of one rood and twenty perches and twelve acres three roods and eight perches hereinbefore awarded to the said Trustees and on or towards the south by the High and Low West fields occupation road ‘‘‘And I do declare that I have set out allotted and awarded’’’ the said allotment of thirty two perches unto the said Trustees in lieu of and in Exchange and in compensation and full satisfaction for a certain annual rent or sum of six pence an acre or thereabouts amounting to the sum of nine shillings and three pence payable and paid by the said Martin Burnell to the said Trustees out of and from or for or in respect of certain lands and tenements held by the said Martin Burnell under and by virtue of the said Lease for one thousand years or some assignment or assignments thereof for the then residue of the said Term as to certain part or parts of the hereditaments thereby demised and in order to enfranchise and discharge the same lands and Tenements and also the said Martin Burnell his executors administrators and assigns and the Lessee or Lessees assignee or assignees for the time being thereof of and from the payment of the said annual rent or sum of six pence an acre or thereabouts amounting to the sum of nine shillings and three pence or of any part thereof ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of thirty two perches shall make and for ever hereafter maintain a good and sufficient fence on the south side thereof

‘‘‘And I do set out allot and award’’’ unto the said Trustees another allotment from the said High and Low West fields containing eleven perches bounded on or towards the East by an allotment of five acres three roods and thirty seven perches awarded to the said Henry Richard Wood in lieu of Glebe on or towards the West and North by allotments containing respectively twelve perches and twelve acres three roods and eight perches and on towards the south by the High and Low West fields occupation road ‘‘‘And I do declare that I have set out allotted and awarded’’’ the said allotment of eleven perches to the said Trustees in lieu of and in exchange and in compensation and full satisfaction for a certain annual rent or sum of six pence an acre or thereabouts amounting to the sum of three shillings and three pence heretofore payable and paid by the said Thomas Dobson and Elizabeth his wife (in her right) and Mary Gee to the said Trustees out of and from or for or in respect of certain Lands and Tenements held by the said Thomas Dobson and Elizabeth his wife in her right and Mary Gee under and by virtue of the said Lease for one thousand years or some assignment or assignments thereof for the then residue of the said Term as to certain part or parts of the hereditaments thereby demised and in order to enfranchise and discharge the same lands and tenements and also the said Thomas Dobson and Elizabeth his wife (in her right) and Mary Gee their executors administrators and assigns respectively and the Lessee or Lessees assignee or assignees for the time being thereof of and from the payment of the said annual rent or sum of six pence an acre or thereabouts amounting to the sum of three shillings and three pence or of any part thereof ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the same allotment shall make and for ever hereafter maintain a good and sufficient fence and ditch on the East side thereof and a good and sufficient fence on the south side thereof

‘‘‘And I do set out allot and award’’’ unto the said ‘’’John Barstow’’’ and ‘’’Elizabeth’’’ his wife (in her right) and Ann Fawcet an allotment from the said Moor and the said Temple field containing six acres two roods and five perches bounded on or towards the East by the said Railway on or towards the West by the Moor road on or towards the North by an allotment of four acres two roods and four perches hereinafter awarded to William Hobson and on or towards the south by the said allotment of twenty seven perches hereinbefore awarded to the said Henry Richard Wood ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of six acres two roods and five perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the West and North sides thereof

‘’’And I do set out and award’’’ unto the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet an allotment from that part of the said arable meadow and pasture Lands and fields agreed to be divided allotted and inclosed called Havercroft containing three acres three roods and thirteen perches bounded on or towards the East by an allotment of four acres and three perches hereinafter awarded to John Hobson on or towards the West and South by antient Inclosures belonging to the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet numbered 191 and 193 on the said plan and on or towards the North by a Lane called York Lane leading from Copmanthorpe to the York and Tadcaster Turnpike road ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of three acres three roods and thirteen perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the East and North sides thereof

‘‘‘And I do set out allot and award’’’ unto the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet as Lessees under and by virtue of the said Lease for one thousand years or some Assignment or Assignments for the then residue of the said Term of some part or parts of the hereditaments thereby demised an allotment from the said York field containing thirteen acres one rood and twenty nine perches bounded on or towards the East by an allotment of fourteen acres one rood and twenty perches hereinafter awarded to Thomas Batman on or towards the West by an allotment containing two acres two roods and four perches hereinbefore awarded to them and by another allotment of three acres one rood and nineteen perches hereinafter awarded to John Hobson on or towards the North by the said Allotment of three acres one rood and nineteen perches and the York and Tadcaster road on or towards the south by the York field occupation road ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of thirteen acres one rood and twenty nine perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the East and South sides thereof and on so much of the North side thereof as adjoins upon the York and Tadcaster road ‘‘‘And I do declare and direct that’’’ the said allotment of thirteen acres one rood and twenty nine perches is so awarded to the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet and shall be considered to be in lieu of and in compensation and full satisfaction for all the right and interest and right and interest and rights and interests of them the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet in to or out of over or upon or for or in respect of such part or parts of the said open and common arable meadow or pasture Lands and fields agreed to be divided allotted and inclosed as were or are held and enjoyed by them under or by virtue of the said Lease for one thousand years or any assignment or assignments thereof for the then residue of the said Term as to any part or parts of the hereditaments thereby demised

‘‘‘And I do set out allot and award’’’ unto the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet an allotment form the York field containing one acre two roods and twenty eight perches bounded on or towards the East by an allotment of three acres one rood and twenty four perches hereinbefore awarded to them on or towards the West by antient inclosures belonging to them and to the said Henry Richard Wood numbered 197 and 199 upon the said plan on or towards the south by an antient Inclosure belonging to the said Henry Richard Wood numbered 202 upon the said plan and on or towards the North by the York field occupation road ‘‘‘And I do declare that I have set out allotted and awarded’’’ the said allotment of one acre two roods and twenty eight perches to the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet in Lieu of and in exchange for an antient Inclosure called Hullay close containing one acre three roods and eight perches numbered 110 on the said plan and hereinbefore awarded to the said Henry Richard Wood in his own right in exchange for such allotment ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the same allotment shall make and for ever hereafter maintain a good and sufficient fence ditch on the North side thereof

‘‘‘And I do set out allot and award unto John Batman’’’ of Copmanthorpe aforesaid Gentleman an allotment from the said High and Low West fields containing twenty nine acres three roods and thirty five perches bounded on or towards the East by an allotment of fifteen acres three roods and three perches hereinbefore awarded to the said Henry Richard Wood as Lessee for years on or towards the West by allotments of one rood and seventeen perches and sixteen acres three roods and fifteen perches hereinbefore awarded to the said Henry Richard Wood as Lessee of the Glebe on or towards the North by the Colton road and on or towards the south by the High and Low West field occupation road ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of twenty nine acres three roods and thirty five perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the East and North sides thereof and a good and sufficient fence on the south side thereof ‘‘‘And I do declare and direct that’’’ the same allotment is so awarded to the said John Batman and shall be and be considered to be in lieu of and in compensation and full satisfaction for all his right and interest and rights and interests in to or out or over or upon or for or in respect of such part or parts of the said open and common arable meadow or pasture lands and fields agreed to be divided allotted and inclosed as were or are held and enjoyed by him under or by virtue of the said Lease for one thousand years or any assignment or assignments thereof for the then residue of the said Term as to any part or parts of the hereditaments thereby demised or otherwise howsoever

‘‘‘And I do set out allot and award’’’ unto ‘’’Thomas Batman’’’ of Copmanthorpe aforesaid Gentleman an allotment from the Temple field containing four acres one rood and five perches bounded on or towards the East by an allotment of two acres three roods and twenty nine perches hereinafter awarded to William Johns on or towards the West by the Moor road and an allotment of one rood and three perches hereinafter awarded to the said Thomas Batman on or towards the North by the same allotment and by the Acaster road and on or towards the south by an allotment of one acre one rood and twenty seven perches hereinafter awarded to Matthew Allan ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of four acres one rood and five perches shall make and for ever hereafter maintain good and sufficient fences and ditches on so much of the West side thereof as adjoins upon the Moor road and on so much of the North side thereof as adjoins upon the acaster road

‘‘‘And I do set out allot and award’’’ unto the said Thomas Batman on allotment from the York field containing fourteen acres one rood and twenty perches bounded on or towards the East by allotments of one acre three roods and twenty eight and four acres and sixteen perches hereinafter awarded to Martin Burnell on or towards the West by an allotment of thirteen acres one rood and twenty nine perches hereinbefore awarded to the said John Barstow and Elizabeth his wife in her right and Ann Fawcet as Lessees for years on or towards the North by the York and Tadcaster Turnpike road and on or towards the south by the York field occupation road ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of fourteen acres one rood and twenty perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the East North and South sides thereof ‘‘‘And I do declare and direct that’’’ the said two allotments containing together eighteen acres two roods and twenty five perches are so awarded to the said Thomas Batman and shall be and considered to be in lieu of and in compensation and full satisfaction for all his right and interest and rights and interests in to or out of or in over or upon or for or in respect of such part or parts of the said open and common arable meadow or pasture Lands and fields agreed to be divided allotted and inclosed as were or are held and enjoyed by him under or by virtue of the said Lease for one thousand years or any assignment or Assignments thereof for the then residue of the said Term as to any part or parts of the hereditaments thereby demised or otherwise howsoever

‘‘‘And I do set out allot and award’’’ unto the saidThomas Batman another allotment in the Temple field containing one rood and three perches bounded on or towards the East and south by the said allotment of four acres one rood and five perches hereinbefore awarded to him on or towards the West by the Moor road and on or towards the North by an antient Inclosure belonging to him numbered 147 upon the said plan ‘’’And I do declare that I have set out allotted and awarded’’’ the said allotment of one rood and three perches to the said Thomas Batman in lieu of and in exchange for part of an antient Inclosure or Garth belonging to him numbered 148 upon the said plan and which has been taken for and made part of the acaster road ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of one rood and three perches shall make and for ever hereafter maintain a good and sufficient fence and ditch on the West side thereof

‘‘‘And I do set out allot and award’’’ unto ‘’’The York and North Midland Railway Company’’’ an allotment from the said Moor containing one acre and eight perches now converted into and forming part of the said Railway and which said Railway is crossed near the centre of the same allotment by the Moor road bounded on or towards the East by an allotment of four acres one rood and twenty three perches hereinafter awarded to the said company (and also now converted into and forming part of the said Railway) on or towards the West by antient Inclosed Lands (also now converted into and forming part of the said Railway) on or towards the North by an allotment of two acres and eighteen perches hereinbefore awarded to the said Trustees and by an allotment of twenty seven perches hereinbefore awarded to the said Henry Richard Wood and on or towards the south by an allotment of three acres two roods and seventeen perches hereinbefore awarded to the said Trustees and an allotment of one acre three roods and fourteen perches hereinbefore awarded to the said Henry Richard Wood ‘‘‘And I do order direct and appoint’’’ that the said company or the owner or owners for the time being of the said allotment shall make and for ever hereafter maintain good and sufficient fences and ditches on the North and south sides thereof

‘‘‘And I do set out allot and award’’’ unto the said Company an allotment from the said Temple containing four acres one rood and twenty three perches (now converted into and forming part of the said Railway and which said Railway is crossed near the East end of the same allotment by the acaster road) bounded on or towards the East by Lands formerly inclosed but now converted into and forming part of the said Railway on or towards the West by the said Allotment of one acre and eight perches last hereinbefore awarded to the said Company and forming part of the said Railway on or towards the North by an allotment of six acres two roods and five perches hereinbefore awarded to the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet and by allotments of four acres two roods and four perches two acres three roods and twenty nine perches one acre and nine perches and fourteen perches hereinafter respectively awarded to William Hobson and William Johnson and the said Company and on or towards the south by allotments of sixty one acres and six perches and fourteen acres two roods and twenty five perches hereinbefore awarded to the said Henry Richard Wood ‘‘‘And I do order direct and appoint’’’ that the said Company or the owner or owners for the time being of the said Allotment of four acres one rood and twenty Three perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the North and south sides thereof

‘‘‘And I do set out allot and award’’’ unto the said Company an allotment from the said York field containing three acres and four perches (now converted into and forming part of the said Railway and which said Railway is crossed towards the East end of the same allotment by the York field occupation road and near the West end thereof by the Wormhills occupation road) bounded on or towards the East and West by lands formerly inclosed but now respectively converted into and forming part of the said Railway on or towards the North by an allotment of four acres two roods and thirty six perches hereinbefore awarded to the said Henry Richard Wood and an allotment of one acre three roods and twenty perches hereinafter awarded to the said Company and on or towards the south by an allotment of nine acres two roods and thirty three perches and by another allotment also of four roods and thirty six perches hereinbefore awarded to the said Henry Richard Wood ‘‘‘And I do order direct and appoint’’’ that the said Company or the owner or owners for the time being of the said allotment of three acres and four perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the North and south sides thereof

‘‘‘And I do set out allot and award’’’ unto the said Company another allotment form the said York field containing one acre three roods and twenty perches bounded on or towards the East by an antient Inclosure belonging to the said Henry Richard Wood numbered 23 upon the said plan on or towards the West by an allotment of fourteen acres one rood and thirty two perches hereinbefore awarded to the said Henry Richard Wood and the York field occupation road on or towards the North by the said Allotment of fourteen acres one rood and thirty two perches and on or towards the south by the said Railway ‘‘‘And I do order direct and appoint’’’ that the said Company or the owner or owners for the time being of the said Allotment shall make and for ever hereafter maintain good and sufficient fences and ditches on the West side and at the Northernmost part of the North side thereof

‘‘‘And I do set out allot and award’’’ unto the said Company another allotment from the said Temple field containing fourteen perches bounded on or towards the North by an antient Inclosure belonging to the said Henry Richard Wood Numbered 145 upon the said plan on or towards the West and south by the acaster road on or towards the East by the said Railway ‘‘‘And I do order direct and appoint’’’ that the said Company or the owner or owners for the time being of the said allotment of fourteen perches shall make and for ever hereafter maintain a good and sufficient fence and ditch on the West and south sides thereof adjoining the acaster road ‘‘‘And I do set out allot and award’’’ unto the said Company another allotment from the said Temple field containing one acre and nine perches bounded on or towards the East and North by the acaster road on or towards the West by an allotment of two acres three roods and twenty nine perches hereinafter awarded to William Johnson and on or towards the south by the said Railway ‘‘‘And I do order direct and appoint’’’ that the said Company or the owner or owners for the time being of the said allotment of one acre and nine perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the East West and North sides thereof ‘‘‘And I do declare and direct that’’’ the said six several allotments containing together eleven acres one rood and thirty eight perches are so set out allotted and awarded to the said Company and shall be and be considered to be in lieu of and in compensation and full satisfaction for all right and interest and rights and interests of the said Company in to or out of or over upon or for or in respect of the open and common arable meadow and pasture Lands and fields and open and common pasture Land agreed to be divided allotted and inclosed as aforesaid in anywise howsoever

‘‘‘And I do set out allot and award’’’ unto ‘’’John Hobson’’’ of Copmanthorpe aforesaid Gentleman an allotment from the York field containing three acres one rood and nineteen perches bounded on or towards the East by an allotment of thirteen acres one rood and twenty nine perches hereinbefore awarded to the said John Barstow and Elizabeth his wife in her right and Ann Fawcet as Lessees for years on or towards the West by an antient Inclosure belonging to the said Henry Richard Wood numbered 194 upon the said plan on or towards the North by the York and Tadcaster Turnpike road and the Lane leading from Copmanthorpe to the said road and on or towards the south by the said allotment of thirteen acres one rood and twenty nine perches and an allotment of two acres two roods and four perches hereinbefore awarded to the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet and an allotment of two acres one rood and three perches hereinafter awarded to Thomas Dobson and Elizabeth his wife in her right and Mary Gee ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of three acres one rood and nineteen perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the East and North sides thereof and a good an sufficient fence on the south side thereof

‘‘‘And I do set out allot and award’’’ unto ‘’’William Hobson’’’ of Copmanthorpe aforesaid Gentleman an allotment from the Temple field and adjoining the Moor road containing four acres two roods and four perches bounded on or towards the East by the said Railway on or towards the West the Moor road on or towards the North by allotments of one acre one rood and twenty seven perches and two acres three roods and twenty nine perches hereinafter awarded to Matthew Allan and William Johnson respectively and on or towards the south by an allotment of six acres two roods and five perches hereinbefore awarded to the said John Barstow and Elizabeth his wife in her right and Ann Fawcet ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of four acres two roods and four perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the North and West sides thereof ‘‘‘And I do set out allot and award’’’ unto the said William Hobson an allotment from the Moor containing five perches bounded on or towards the East by Hobsons occupation road South on or towards the West and South by an antient Inclosure belonging to him numbered 66 upon the said Plan and on or towards the North by Hobson’s occupation road ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the same Allotment shall make and for ever hereafter maintain good and sufficient fences and ditches on the East and North sides thereof ‘‘‘And I do set out allot and award’’’ unto the said William Hobson a piece of Glebe Land in antient Inclosures belonging to him called Moor close and numbered 65 upon the said plan containing one rood and fourteen perches bounded on or towards the East and West by the said antient Inclosure on or towards the North by an antient Inclosure belonging to him Numbered 35 on the said plan and on or towards the south by an antient Inclosure belonging to the said Trustees numbered 57 upon the Plan ‘‘‘And I do declare that I have set out allotted and awarded’’’ the said last mentioned allotment unto the said William Hobson in lieu of and in exchange for an allotment of one rood and seventeen perches from the High and Low West fields hereinbefore awarded in exchange to the said Henry Richard Wood in lieu of Glebe ‘’’And I do also declare and direct’’’ that the said three allotments last hereinbefore awarded to the said William Hobson containing together four acres three roods and twenty three perches are so awarded to him and together with the enfranchisement and discharge hereinbefore mentioned or referred to and hereinafter contained thereof and of the lands and tenements held by the said William Hobson under and by virtue of the said Lease for one thousand years or any assignment or assignments thereof for the then residue of the said term as to any part or parts of the hereditaments thereby demised from the said rent or annual sum of six pence an acre or thereabouts amounting to the sum of seventeen shillings and six pence heretofore payable and paid by the said William Hobson to the said Trustees out of and from or for or in respect of the same lands and tenements are and is and shall be and be considered to be in lieu of and in compensation and full satisfaction for all the right and interest and rights and interests of him the said William Hobson in to or out of or over or upon or for or in respect of such part and parts of the said open and common arable meadow and pasture Lands and fields agreed to be divided allotted and inclosed as were or are held and enjoyed by him under and by virtue of the said Lease for one thousand years or any assignment or assignments thereof for the then residue of the said Term as to any part or parts of the hereditaments thereby demised or otherwise howsoever

‘‘‘And I do set out allot and award’’’ unto ‘’’Martin Burnell’’’ of Bishopthorpe in the County of York Gentleman and allotment from the York field containing four acres and sixteen perches bounded on or towards the East by an allotment of fourteen acres one rood and thirty two perches hereinbefore awarded to the said Henry Richard Wood on or towards the West by an allotment of fourteen acres one rood and twenty perches hereinbefore awarded to Thomas Batman on or towards the North by the York and Tadcaster Turnpike road and on or towards the south by an allotment of one acre three roods and twenty eight perches next hereinafter awarded to the said Martin Burnell ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of four acres and sixteen perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the East and North sides thereof ‘‘‘And I do declare and direct that’’’ the same allotment is so awarded to the said Martin Burnell and together with the enfranchisement and discharge hereinbefore mentioned or referred to and hereinafter contained thereof and of the lands and tenements held by the said Martin Burnell under or by virtue of the said Lease for one thousand years or any assignment or assignments thereof for the then residue of the said Term as to any part or parts of the hereditaments thereby demised from the said rent or annual sum of six pence an acre or thereabouts amounting to the sum of nine shillings and three pence heretofore payable and paid by the said Martin Burnell to the said Trustees out of and from or for or in respect of the same lands and tenements are and is and shall be and be considered to be in lieu and compensation and full satisfaction for all the right and interest and rights and interests him the said Martin Burnell in to or out of or over or upon or for or in respect of such part and parts of the said open and common arable meadow and pasture Lands and fields agreed to be divided allotted and inclosed or was or are held and enjoyed by him under or by virtue of the said Lease for one thousand years or any assignment or assignments thereof for the then residue of the said Term as to any part or parts of the hereditaments thereby demised or otherwise howsoever ‘’’And I do allot award and assign’’’ unto the said Martin Burnell an allotment from the York field containing one acre three roods and twenty eight perches bounded on or towards the East by the said allotment of fourteen acres one rood and thirty two perches to thesaid Henry Richard Wood on or towards the West by the said allotment of fourteen acres one rood and twenty perches to Thomas Batman on or towards the North by the said allotment of four acres and sixteen perches to Martin Burnell and on or towards the south by the York field occupation road ‘‘‘And I do declare that I have set out allotted and awarded’’’ the said allotment of one acre three roods and twenty eight perches to the said Martin Burnell in lieu of and in exchange for an antient Inclosure called the Moor close containing one acre one rood and thirty five perches numbered 30 upon the said plan hereinbefore awarded to the said Trustees in exchange for such allotment ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of one acre three roods and eight perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the East and south sides thereof

‘‘‘And I do set out allot and award’’’ unto ‘’’William Johnson’’’ of Copmanthorpe aforesaid yeoman an allotment from the Temple field containing two acres three roods and twenty nine perches bounded on or towards the East by an allotment of one acre and nine perches hereinbefore awarded to the said Railway Company on or towards the West by an allotment of four acres one rood and five perches hereinbefore awarded to Thomas Batman and of one acre one rood and twenty seven perches hereinafter awarded to Matthew Allan on or towards the North by the Acaster road and on or towards the south by the said Railway and by an allotment of four acres two roods and four perches hereinbefore awarded to William Hobson ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of two acres three roods and twenty nine perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the West and North sides thereof ‘‘‘And I do declare and direct that’’’ the same allotment is so made to the said William Johnson and shall be and be considered to be in lieu of and in compensation and full satisfaction for all the right and interest and rights and interests of him the said William Johnson as to out of or over upon or for or in respect of such part and parts of the said open and common arable meadow and pasture lands and fields directed to be divided allotted and inclosed as were or are held and enjoyed by him under or by virtue of the said Lease for one thousand years or any assignment or assignments thereof for the then residue of the said Term as to any part or parts of the hereditaments thereby demised or otherwise howsoever

‘‘‘And I do set out allot and award’’’ unto ‘’’Thomas Dobson’’’ of Newcastle upon Tyne and ‘’’Elizabeth’’’ his wife in her right and Mary Gee of the same place Spinster an allotment from the said York field containing two acres one rood and three perches bounded on or towards the East by an allotment of two acres two roods and four perches hereinbefore awarded to the said John Barstow and Elizabeth his wife (in her right) and Ann Fawcet on or towards the West by an antient Inclosure belonging to the said Thomas Dobson and Elizabeth his wife (in her right) and Mary Gee Numbered 195 and 196 upon the said plan on or towards the North by an allotment of three acres one rood and nineteen perches hereinbefore awarded to John Hobson and on or towards the south by the York field occupation road ‘‘‘And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of two acres one rood and three perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the East and south sides thereof ‘‘‘And I do declare and direct that’’’ the same allotment is awarded to the said Thomas Dobson and Elizabeth his wife (in her right) and Mary Gee and together with the enfranchisement and discharge hereinbefore mentioned or referred to and hereafter contained thereof and of the lands and tenements held by the said Thomas Dobson and Elizabeth his wife (in her right) and Mary Gee under or by virtue of the said Lease for one thousand years or any assignment or assignments thereof for the then residue of the said Term as to any part or parts of the hereditaments thereby demised from the said rent or annual sum of six pence an acre or thereabouts amounting to the sum of three shillings and three pence theretofore payable and paid by the said Thomas Dobson and Elizabeth his wife (in her right) and Mary Gee to the said Trustees out of and from or for or in respect of the same lands and tenements and are and is and shall be and be considered to be in lieu and compensation and full satisfaction for all the right and interest and rights and interests of them the said Thomas Dobson and Elizabeth his wife (in her right) and Mary Gee in to or out of or over upon or for or in respect of such part or parts of the said open and common arable meadow and pasture Lands and fields agreed to be divided allotted and inclosed as were or are held by them under or by virtue of the said Lease for one thousand years or any assignment or assignments thereof for the then residue of the said Term as to any part or parts of the hereditaments thereby demised or otherwise howsoever

‘’In Lieu of side pieces’’

‘’’And I do set out allot and award’’’ unto ‘’’William Lamb’’’ of Copmanthorpe aforesaid Labourer an allotment adjoining the Moor road containing six perchesbounded on or towards the East by the Moor road on or towards the West by an allotment of one acre and two perches hereinbefore awarded to the said Trustees and an allotment of four perches hereinafter awarded to Robert Fisher and on or towards the North by an antient Inclosure belonging to the said William Lamb numbered 173 upon the said Plan ‘’’And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of six perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the East West and south sides thereof ‘’’And I do declare and direct’’’ that the same allotment is so awarded to the said William Lamb and shall be and be considered to be in lieu of and compensation and full satisfaction for all the right and interest and rights and interests of him the said William Lamb in to out of over or upon or in respect of any part or parts of the said open and common arable meadow and pasture Lands and fields directed to be divided and inclosed in any wise howsoever

‘’’And I do set out allot and award’’’ unto ‘’’Robert Fisher’’’ of the Suburbs of the City of York Ale draper an allotment adjoining the Moor road containing four perches bounded on or towards the East by the Moor road on or towards the West and south by the said allotment of one acre and two perches to the said Trustees and on or towards the North by the said allotment of six perches to William Lamb ‘’’And I do order direct and appoint’’’ that the owner or owners for the time being of the said allotment of four perches shall make and for ever hereafter maintain good and sufficient fences and ditches on the East West and south sides thereof ‘’’And I do declare and direct’’’ that the same allotment is so awarded to the said Robert fisher and shall be and be considered to be in lieu of and compensation and full satisfaction for all the right and interest and rights and interests of him the said Robert Fisher in to out of over or upon or in respect of any part or parts of the said open and Common arable meadow and Pasture Lands and fields directed to be divided allotted and inclosed in any wise howsoever

‘’’And I do hereby’’’ enfranchise and discharge ‘’’And declare and direct’’’ to be enfranchised and discharged the respective Lands and tenements held by the said Henry Richard Wood William Hobson Martin Burnell Matthew Allan and Thomas Dobson and Elizabeth his wife (in her right) and Mary Gee respectively under or by virtue of the said Lease for one thousand years or any assignment or assignments thereof for the then residue of the said Term as to any part or parts of the hereditaments thereby demised and also the said Henry Richard Wood William Hobson Martin Burnell Matthew Allan and Thomas Dobson and Elizabeth his wife (in her right) and Mary Gee severally and respectively and their several and respective Executors administrators and assigns and the several and respective Lessee and Lessees assignee and assignees for the time being of the same lands and tenements respectively of and from the Charge thereon payment of or liability to the several annual rents or sums of money of six pence an acre or thereabouts amounting to the several sums hereinbefore mentioned and particularised as to such lands and tenements respectively and heretofore payable and paid by them and each or any of them respectively to the said Trustees out of and from or for or in respect of such lands and tenements respectively

‘’’And I do order direct and appoint’’’ that none of the ditches hereinbefore directed to be made and maintained shall be of less dimensions than three feet in width at the Top and that such ditches shall be made of a sufficient depth to carry off the water from the lands which are to be drained thereby and that the recesses for the Quickwood to be planted in the Hedge rows be at least fifteen inches from the edges of such ditches ‘’’And I do also order direct and appoint’’’ that the owner or owners for the time being of the several and respective allotments hereinbefore set out allotted and awarded shall make and for ever hereafter maintain good and sufficient Bridges or Tunnels over or under the respective gateways to such allotments for the free passage of the water through or under the same ‘’’And I do also order and direct’’’ that the owner or occupiers for the time being of the same several respective allotments shall and may from time to time and at all or any time or times hereafter have and be intitled to the power of cutting Drains Ditches and Grips or of forming hollow drains into the Ditch or Ditches of the adjoining lands belonging to other persons for the purpose of conveying the water from such allotments into the Ditches of such adjoining Lands ‘’’And I do order and direct’’’ that no person or persons whomsoever shall dig or carry away any stones Gravel sand or soil whatever from off the public or private roads hereinbefore set out or any part or parts thereof ‘’’And I do order and direct’’’ That all and each of the Gates from the roads into the said allotments and closes shall open into the said allotments and closes respectively and not into such roads
