taken and subscribed should be annexed to and inrolled with the

the purposes of such Act, and the number of Areas and Divisional parts of an Area in Statute measure contained in all the Lands and Grounds directed or authorised to be divided, allotted and inclosed, and also in all the Ancient Inclosed Lands, Grounds and Homesteads aforesaid, and of each and every proprietor’s distinct property in the same respectively at the time of making such Survey and Admeasurement should be therein set forth and specified, and that the said Survey, Admeasurement, Plan and Valuation should be kept by such Commissioner or Commissioners, and the person or persons who should make such Survey, Admeasurement, Plan and Valuation should verify the same in manner therein men- tioned: Provided always that any Map or Survey made at the time of passing any such Act which should be tendered to such Commissioner or Commissioners, and which should be in his or their judgment and to his or their satisfaction, a just and true Map or Survey proper for the purpose of carrying any such Act into execution, might be used for that purpose, if the said Commissioner or Commissioners should think fit, without any new Map or Survey being made of such part of the Lands and Grounds as should be comprised in any such approved Map or Survey as aforesaid.

And it was further Enacted that all persons and Claims to be

Lands so to be enclosed should deliver or cause to be delivered to such Commissioner or Commis- sioners in the manner and within the period to be named by such Commissioner or Commissioners, an Account or Schedule in writing of such their respective rights or claims, or on non-compliance therewith every of them making default therein should as far only as respects any claims so neglected to be delivered, be totally barred and excluded of and from all right and title in or upon such Lands so to be divided respectively, and of and from all benefit and advantage in or to any share or allotment thereof. Provided and it was further Enacted that nothing therein contained should authorise such Commissioner or Commis- sioners to hear and determine any difference or dispute which might arise touching the right or title to any Lands, Tenements or Hereditaments but such Commissioner or Commissioners should assign and set out the several allotments directed to be made unto the person or persons who at the time of the division and inclosure should have the actual seizin or possession of the Lands, Tenements or Hereditaments in lieu or in right whereof such allotment should be respectively made.

And it was further Enacted that such Commis- sioner or Commissioners should and he and they was and were thereby authorised and required in the first place, before he or they proceed to make any of the divisions and allotments directed in

and by any such

All other Roads to be extinguished

Justices of the Peace acting in and for the County in which such roads should lie, be declared to be fully and sufficiently formed, completed and repaired, the same should be supported and kept in repair by such persons and in like manner as the other Public Roads within such parish, town- ship or place, were by Law to be amended and

kept in repair.

And it was further Enacted that such Commis- sioner or Commissioners should and he or they was and were thereby empowered and required to set out and appoint such Private Roads, Bridle- ways, Footways, Ditches, Drains, Watercourses, Watering Places, Quarries, Bridges, Gates, Stiles, Mounds, Fences, Banks, Bounds and Land-marks in, over, upon and through or by the sides of the allotments to be made and set out in pursuance of such Act as he or they should think requisite,

‘and the same should be made and at all times for

ever thereafter be supported and kept in repair by and at the expense of the Owners and Proprietors for the time being of the Lands and Grounds directed to be divided and inclosed in such shares and proportions as the Commissioner or Commis- sioners should in and by his and their Award

order and direct.

And it was further Enacted that after such Public and Private Roads and Ways should have been set out and made all Roads, Ways and Paths over through and upon such Lands and Grounds

which should not be set out as aforesaid should be for ever stopped up and extinguished, and should be deemed and taken as part of the Lands and Grounds to be divided, allotted and inclosed, and should

parcel thereof which should be so allotted, assigned or exchanged, and the Situations and Descriptions of the same respectively, and should also contain a description of the Roads, Ways, Footpaths, Watercourses, Watering Places, Quarries, Bridges, Fences and Land-marks set out and appointed by the said Commissioner or Commissioners res- pectively as aforesaid, and all such other Rules, Orders, Agreements, Regulations, Directions and Determinations as the said Commissioner or Commissioners should think necessary, proper or beneficial to the parties, and also that the said respective Commissioners, if they think it necessary should form or draw or cause to be formed and drawn on parchment or vellum such Maps or Plans of the said Lands and Grounds the better to describe the several new Allotments or Divisions to be made and Premises that should be exchanged by virtue of the now existing Act, and which should express the quantity of each Allotment in acres, roods and perches,

should be only so far effective and binding in each particular case as they or any of them should not be otherwise provided and enacted in any such Act thereafter to be passed as afore- said. AnD WHEREAS in and by an Act of Parliament Golear made and passed in the first year of the reign of Act. his present Majesty King George the Fourth, intituled “An Act for inclosing Lands in the Manor of Golear, in the Parish of Huddersfield,

in the West Riding of the County of York.”

After reciting (amongst other things) that within the Manor of

Lands and Tenements within the said Manor of Golear, are entitled to right of Common upon the said Commons, Moors and Wastes.

And also Reciting the hereinbefore recited Act of the forty-first year of the reign of his late Majesty King George the Third. It is in and by the said Act of the first year of the reign of his present Majesty, Enacted that all the said Commons, Moors and Waste Grounds should as soon as conveniently might be, be set out, divided and allotted unto and amongst the several Owners and Proprietors and other persons interested, according to their several and respective Rights and Interests therein, by us, the said William Pilkington and Frederick Jones, and we are there- by appointed Commissioners for that purpose, and for carrying the several purposes of the now existing Act and the hereinbefore recited Act into execution (except such parts of the hereinbefore recited Act as are by the now existing Act altered or varied), and under and subject to the directions in the now existing Act contained, and to such of the Rules, Orders, Regulations, Restrictions and Directions contained in the hereinbefore recited Act as are not repugnant to or varied or controlled by or otherwise provided for by the now reciting Act.

And it is in and by the said Act of the first year of the reign of his present Majesty further Enacted that Thomas Tinsley, of Huddersfield, in

the County of York, Land Surveyor, should be and he is thereby appointed Surveyor of the said Commons, Moors and Waste Grounds, and also of such of the Ancient Inclosed Lands within the said Manor as the said Commissioners should think necessary to be surveyed for the purposes of the said Act. Provided always that the said Thomas Tinsley, or such other person or persons so to be appointed Surveyor or Surveyors before he or they should proceed to act as such Surveyor or Surveyors should take and subscribe the Oath or

execution, and having had several meetings from time to time according to and in pursuance of the said respective Acts of Parliament, and having also fully, duly and deliberately weighed, con- sidered and examined into all and every the matters and things referred to our arbitration and judgment in and by the said second hereinbefore recited Act, Do on the day of the date of those presents, in obedience to the said Act, and in pursuance and by virtue of the several Powers, Authorities and Directions thereby and by the first hereinbefore recited Act to us given, Make, Publish and Declare this writing under our hands and seals to be our Award, Order, Arbitrament, and final Determination touching and concerning all and every the premises in manner and form following (that is to say) :—

WHEREAS in pursuance of the Directions con- tained in the said first nereinbefore recited Act, and before proceeding to any Division of the Commons, Moors and Waste Grounds in and by the said second hereinbefore recited Act directed to be divided and allotted, We the said Commis- sioners did enquire into the Boundaries of the said Manor of Golcar, and upon such enquiry found that the Boundaries of the said Manor of Golear and those of the adjoining Parishes, Manors, Hamlets or Districts were sufficiently

ascertained and distinguished.

And the quantity of each and every part and parcel thereof is allotted, assigned or exchanged, and the Situations and Descriptions of the same respectively, and the other matters and things required by the first hereinbefore recited Act to be set forth in this our Award, are accordingly hereinafter set forth.

AND WHEREAS it 1s in and by the said second hereinbefore recited Act further Enacted that it should and might be lawful for the said Commis- sioners to set out, make and appoint such Public or Private Carriage or other Roads as they should think proper over any of the Encroachments, Lands and Grounds intended to be divided and allotted by virtue of the said Act, to stop up, discontinue, divert or alter any Carriage Road, Bridleway or Footpath (except Turnpike Roads) leading through or over the Lands and Grounds intended to be divided or allotted by virtue of the said Act, and also to stop up or discontinue, or to divert, widen or alter any Public Carriage Road,

Bridleway or Footpath passing or leading through any of the inclosed Lands within the Township of Golear, as they should think proper, and the soil of the Roads and Ways so to be stopped up or discontinued should be deemed and taken as part of the Lands and Grounds to be divided and allotted by virtue of the said Act, Provided that no Carriage Road, Bridleway or Footpath passing or leading through any of the inclosed Lands in the said Township should be stopped or discontinued, diverted or altered, except under the Rules, Regulations and Restrictions provided by an Act passed in the fifty-fifth year of the reion of his late Majesty, intituled ‘‘ An Act to amend an Act of the thirteenth year of his then present Majesty, for the amendment and preser- vation of the Public Highways in so far as the same relates to Notice of Appeal against turning or diverting a Public Highway, and to extend the provisions of the same Act to the stopping up of unnecessary Roads,” and the same should be subject to Appeal in manner by such Act directed.

AnD WHEREAS it is in and by the said second Ctause

hereinbefore recited Act further Enacted that the

and for that purpose to take a sufficient quantity of the Ancient Inclosed Lands or Grounds adjoining to such Roads, the same not being a Yard, Garden, Orchard, Park, Paddock, Plantation or Avenue to any House, and the said Commis- sioners should and they are thereby authorised and empowered to make a full compensation for the value of the Land or Ground so to be taken for the widening of such Public Road, by allotting and awarding unto the person or persons from whom any such Ancient Inclosed Land or Ground should be so taken an adequate part or parts of the said Commons, Moors or Waste Grounds, and that the said Commissioners should and they are thereby authorised and empowered to make good and substantial fences on each side of all such widened Roads for and in lieu of the fences which should be injured or destroyed by means of such widening, and that the Charges and Expenses attending the widening such Roads and making such Fences as aforesaid, should be raised and paid in such and the like manner as the expenses of and attending the now existing Act were thereby directed to be raised.

THEREFORE, we the said Commissioners in pursuance of the Authority and Directions of the said hereinbefore recited Acts or one of them for setting out, making and appointing Public or Private Carriage or other Roads over the Lands or Grounds directed to be divided or allotted,

Have set out and appointed, and by those presents Do set out, appoint and award the several Public Carriage Roads and Highways hereinafter men- tioned and described, which we judge necessary to be made through and over the said Commons, Moors and Waste Grounds within the said Manor of Golcar, all which said Public Carriage Roads are set out of the several and respective widths between the fences as are hereinafter mentioned and are set out in such directions as appear to us most commodious to the public, and are as follows, that is to say, One Public Carriage Road and Ley Moor Highway of the width of thirty feet where the same passes over open Common as and where the same is now staked out commencing at the west end of an ancient Lane at the bottom of Ley Moor, and leading in a westwardly direction up Ley Moor to the Golcar Hill and Swallow Lane Road at Golear Fold, which we call Ley Moor Road. One other Public Carriage Road and Stoney Lane Highway of the width of thirty feet, branching out of the last described road at the south east corner of an ancient Inclosure called Darby Field, and leading in a northwardly direction to the south east end of Stoney Lane, which we call Stoney Lane Road. One other Public Carriage Longwood Road and Highway of the width of thirty feet commencing at the north end of Pike Law Lane at Pike Law Edge, and leading in a northwardly direction over the east end of Wholestone Moor to the Township of Longwood, which we call

at the south end of Smith Lane, and leading in a southwardly direction past Head Wall Green to the north end of Watt Royd Lane, which we call Head Wall Green Road. One other Public Golcar Edge Carriage Road and Highway of the width of thirty House Road. feet, where the same passes over open Common, commencing at Shire Gate and leading in a west- wardly direction through Golcar Edge and Brook Lanes to Copley Bank, and thence in a south- wardly direction to Lower Well House, which we call Golear Edge and Well House Road. direction under Rocking Stone Hill to the Hud- dersfield and New Hey Turnpike Road, near to the Royal George Public House, in the Manor of Scammonden, which we call Royal George Road.

Carriage and Occupation Road of the width of eighteen feet, branching out of the Royal George Road, near to Rocking Stone Hill, and leading in a southwardly direction to the Township of Slaithwaite, which we call Launds Road. One other Public Bridle and Private Carriage and Occupation Road of the width of twenty-four feet, commencing at the south end of Smith Lane and leading in a south westwardly direction over Bolster Moor to the Bolster Moor Road, and thence in the same direction to the Enden Edge Road, on Enden Edge, which we call Smith Lane Road. And One other Public Bridle and Private Carriage and Occupation Road of the width of twenty-four feet, branching out of the Clough Head Road at Clough Head, and leading in a north westwardly direction across Harts Hole Common to the Royal George Road, which we call Harts Hole Road.

And we do hereby award, order and direct that the several Public Bridle Roads above-mentioned and described, so far as the same are Public Roads, shall for ever hereafter be supported and kept in repair by such persons and in like manner as the other Public Bridle Roads within the said Manor of Golcar are by Law required to be kept in repair.

AND we do hereby appoint, set out and award

Moor Road at the bottom of Ley Moor, and leading in a north westwardly direction to Willan’s Cottage, which we call Willan’s Road. One other Private Carriage and Occupation Road of the width of fifteen feet, branching out of the south east end of Haugh’s Road, and leading in a north westwarcly and northwardly direction into the Haugh’s Road, which we call Savile’s Road. One other Private Carriage and Occupation Road Heath House of the width of fifteen feet, branching out of the Bolster Moor Road, and leading in a northwardly direction to Heath House, and thence in a north westwardly direction across Bolster Moor to the Head Wall Green Road, at the south end of Smith Lane, which we call Heath House Road. One other Private Carriage and Occupation Road Ridings of the width of twelve feet, branching out of the Golcar Hill and Swallow Lane Road at Cliff Ash, and leading in a south westwardly direction to the east end of Ridings Lane, which we call Ridings Road. One other Private Carriage and Knowl Bank Occupation Road of the width of twelve feet, branching out of the Ridings Road, and leading in an eastwardly direction through Golcar Edge past Knowl Bank to the Golcar Edge and Well House Road, at a place called Kiln Brow, which we call Knowl Bank Road. One other Private

One other Private Quarry Road Carriage and Occupation Road of the width of eighteen feet, commencing at the Royal George Road on the Launds Common, and leading in a northwardly direction to the south west corner of an Allotment herein awarded to the Surveyors of the Highways of the Township of

Repairs of Private Carriage and Occupation Roads over Waste Grounds.

Private Carriage and Occupation Roads before- mentioned we have set out and appointed for the sole and exclusive use of the Owners and Occu- piers of the Estates and Allotments lying adjacent or adjoining to any of the said Roads and to which such Roads respectively lead.

AND we do hereby order, direct and award that the said several Roads called Ley Moor Bottom Road, Pike Law Edge Road, Haugh’s Road, Enden Edge Road, Copley Bank Road, Launds Road, Smith Lane Road, and Harts Hole Road, so far as the same are Private Carriage and Occupation Roads, and also all the said several other Private Carriage and Occupation Roads by us so set out and appointed, so far as such Roads respectively run through, over and upon the said Commons, Moors and Waste Grounds shall for ever hereafter be supported, maintained and kept in repair by and at the general expense of the Owners or Occupiers of Allotments upon the said Commons, Moors and Waste Grounds, in the shares and proportions mentioned and specified in the Rate or Assessment hereunto annexed and marked or intitled.

“The Rate or Assessment of fivepence in the pound referred to, by which the Owners or Occu- piers of Allotments on the Commons, Moors and Waste Grounds within the Manor or Township of Gelear, in the Parish of Huddersfield, for the

time being, are to proportion the expense of the

Roads set out and awarded in and over the said Commons, Moors and Waste Grounds and the Allotments

And we do Order and Direct that some person or persons shall once in every year for ever here- after be appointed for one year only (when a aew appointment shall be made), by a majoritv in number of the Occupiers of Allotments upon the said Commons, Moors and Waste Grounds, who shall be present at a meeting to be called for that purpose, and holden within the said Manor or Township of Golcar, on or before the tenth day of October in every year, and of the time and place of holding which meeting public notice in writing shall be given, signed by any three or more of the occupiers of such Allotments, and liable to contribute to the repair of the said Roads, and shall be fixed upon the Chapel Door in Longwood some Sunday not less than fourteen days before the day of such meeting. And such person or persons so appointed in manner afore- said, shall from time to time and at all times for ever hereafter, as often as occasion shall require, make or cause to be made and kept in good and sufficient repair, the said Private Carriage and Occupation Roads hereinbefore directed to be repaired with the money arising from the said Rate or Assessment, and also shall from time to time, and at all times so often as occasion shall re- quire,make or cause to be made an equaland regular

Assessment or equal and regular Assessments by Rates, in the proportions set forth in the said Rate or Assessment annexed to this our Award, upon all and every the Owner or Owners, Proprietors or Occupiers of the several allotments on the said Commons, Moors and Waste Grounds by us hereinafter allotted and awarded according to the said Rate or Assessment, and pay and apply the money to arise from such Rates in the manner we have hereinbefore directed. And that the person or persons for the time being to be chosen as aforesaid, shall yearly and every year, make out and render on or before the tenth day of October in every year, at the said meeting to be called in manner and for the purposes afore- said, a true and faithful account to the Owners or Occupiers of Allotments of all such sum and sums of money as he or they shall have respectively received, and in what manner the said moneys have been laid out and expended, and shall pay over any surplus of the money to arise as afore- said, which shall then be in his or their hands unto the person or persons to be appointed next in succession, to be by him or them applied to the purposes aforesaid. And in case of the person or persons so to be appointed as aforesaid refusing or neglecting during the time of his or their being Surveyor or Surveyors to keep in such good and sufficient repair all or any of the said Private Carriage and Occupation Roads, or to collect the said Rate or Assessment, or if any Owners or

Occupiers of the said several Allotments shall refuse or neglect to pay his or their proportion or proportions of the said Rate or Assessment upon I demand, such Surveyor or Surveyors so refusing or neglecting as aforesaid, and such Owners or Occupiers of the said several Allotments so refusing or neglecting to pay his or their propor- tion of the said Rate or Assessment, shall on Conviction thereof before one or more Justices of the Peace acting in and for the West Riding of the County of York, and not interested in the matter in question, forfeit a sum not less than forty shillings nor more than ten pounds, at the discretion of the said Justice or Justices, which penalty shall be levied in the manner prescribed in and by the said Act of the forty-first year of his late Majesty’s reign, and after a deduction thereout of the expenses attending such convic- tion, the remainder of such penalty shall be paid and applied towards the repair of the said Private Carriage and Occupation Roads.

And we do also order and direct that the said respective Public Footways or Paths by us here- inbefore set out, appointed and awarded, shall be of the width of five feet, and whenever any Owners or Occupiers of Allotments into, through or over which they lead, shall think proper to fence any of them off, such of the said Footways or Paths so to be fenced off shall be of the width of five feet exclusive of fences and ditches.

AND WHEREAS it is in and by the said second hereinbefore recited Act further Enacted that it should be lawful for the said Commissioners, and they are thereby empowered to direct, order and award any Streams of Water, Springs or Water- eourses within the said Commons, Moors and Waste Grounds thereby intended to be divided, allotted and inclosed, to be varied and conveyed in such courses and through such part or parts of the same Commons, Moors and Waste Grounds as they in their discretion should think necessary and proper, but nevertheless so as not to occasion prejudice to the owner of any mill or any other person or persons entitled to the benefit of any such Stream of Water, Spring or Watercourse, and provided that no Stream, Spring or Water- course should be diverted or turned from or into any Lands or Grounds of any person or persons without the consent in writing of the Owners or Proprietors of such Lands or Grounds respectively first had and obtained for that purpose.

her and their Tenants and Occupiers of Estates situate within the said Township, for the purpose of building or repairing any Messuages or Tena- ments,Outhouses,or other Buildings and Erections, Walls or Fences, or otherwise improving their said Estates, within the said Township of Golcar, but not to be given away, sold, exchanged. or elsewhere or otherwise used, applied, or disposed of, and the soil and surface of the Lands and Grounds to be set out for Public Stone Quarries as aforesaid (but without prejudice to the rights and privileges thereby given and allowed therein respectively), should from and after the execution of the Award of the said Commissioners be vested in the Surveyor or Surveyors of the Highways for the time being within the said Township of Golear in Trust, to let the same for the most money that can be made thereof, and to apply the Rents and Profits arising from the same towards the repairs of the Public Roads or High- ways within the said Township, and the said Surveyor or Surveyors should account for such Rents and Profits in the same manner as he or they are accountable for any other money that should come to his or their hands as Surveyor or Surveyors of the Highways, and should be under and subject to the like penalties for the neglect thereof.

AND it is in and by the said last recited Act further Enacted that after all the Stone should

Expenses of obtaining and executing the now reciting Act; but the same fences when made should for ever afterwards be repaired and main- tained by the Lord or Lords for the time being of the said Manor or his or their Assigns, and the said Commissioners should also cause all other the Allotments to be set out for the said Lord of the said Manor, under and by virtue of the now reciting Act to be well and sufficiently Ring- fenced of a proper height with good and sufficient Stone Walls, and should pay and defray the Expenses of making thereof and should also pay and defray his part or share of the Expense of obtaining and putting the now reciting Act into execution by and out of the Monies to be raised as thereinafter directed ; but it should be lawful for the said Commissioners to deduct from the Allotments to be so made to the said Lord of the said Manor as last mentioned so much as in their judgment should be equal in value to his pro- portion of the Expense of obtaining and putting into execution the now reciting Act, and the Expenses of Ring-fencing the last-mentioned Allotment or Allotments so to be made aforesaid. And the said Commissioners should allot and award the Land so to be deducted unto and equally amongst the Proprietors and Owners of Estates within the Township of Golcar aforesaid.

any part of the said Allotment to any Person or Persons whomsoever for any term of Years not exceeding twenty-one Years, so that every such Lease there be reserved and made payable to the said Trustees by equal half yearly payments in every Year, the best and most improved Yearly Rent or Rents that can be obtained for the Allot- ment so to be Leased without taking any Income, Fine, Premium, or Foregift in consideration of granting such Lease or Leases, and so that in all such Leases there be contained the Usual Coven- ants and Stipulations between Lessors and Lessees, and such other Covenants and Stipula- tions and Security for the performance of the same as the said Trustees should think proper to be inserted therein, and the Rents and Profits arising from the said Allotment should from time to time be laid out in purchasing Fuel or Cloath- ing and such Fuel or Cloathing should be distributed amongst the Poor Inhabitants of the said Township of Golear who should be legally settled and resident therein in such Shares and Proportions, at such times in every Year and according to such Rules and Directions as should from time to time be made and prescribed by the said Trustees for that purpose and not otherwise.

THEREFORE we, the said Commissioners, in pursuance and obedience to the directions of the said Act, Do set out, allot, and award unto the Overseers of the Poor of the Township of Golcar

authorised and required to set out, allot, and award the residue of all the said Commons, Moors, and Waste Grounds thereby directed to be divided and inclosed unto and amongst the several Owners and Proprietors of Ancient Messuages, Cottages, and Tofts having Right of Common thereon, and also unto and amongst the Owners and Proprietors of Ancient Inclosed Lands with- in the said Township of Golcar (except such Messuages and Cottages as should be proved to the satisfaction of the said Commissioners to have been erected upon Encroachments, and also except any Lands which should in like manner be proved to be an Encroachment), in due proportion to the annual value of their respective Messuages, Cottages, Tofts, and Lands to be settled and determined by the said Commissioners (in which valuation no Messuage should be estimated at more than the annual value of five pounds) and in full bar and compensation ot and for their respective Rights of Common or other Rights or Interests in, over, and upon the said Commons, Moors, and Waste Grounds, or any part thereof, and the said several Allotments should be laid as contiguous and near to the respective Estates of the several persons entitled to the same as con- veniently might be. And that in ascertaining the Estimated.

thereby required to estimate the value thereof according to the nature and quality of the Soil thereof as if no wood was growing thereon

And it is thereby further Enacted that when and so soon as the said Commissioners should have ascertained the respective Rights and Interests of the said Proprietors in the Lands and Grounds to be divided and inclosed by virtue of the said Act, and also the respective Shares and Proportions by them proposed to be allotted to such proprietors respectively in lieu thereof, they the said Commissioners should give notice in manner aforesaid of some convenient time and place when and where the proprietors might be informed of such intended Allotments, and a Map or Plan should be produced for their inspection and as some Proprietors might upon inspection of such Map or Plan be dissatisfied with the intended Allotments, the said Commissioners should at such time and place as last aforesaid, or some other time and place to be appointed by them for the purpose, receive statements in writing of the complaints and objections against such Allot- ments and should forthwith or as soon as con- veniently might be determine the same, and their determination therein as to the said Allotments Should be final and conclusive on all parties unless appealed against by virtue of the provisions in

the said Act contained.

And it is thereby further Enacted that it should be lawful for any person or persons who should be entitled to any Allotment or Allotments under or by virtue of the said Act to appoint, give, grant, bargain, sell, demise, mortgage, limit, con. vey, and assure the same for all or any part of his, her, or their estate or interest therein or right thereto at any time before the execution of the award of the said Commissioners, and the said Commissioners are thereby required to award such Allotment or Allotments accordingly and every such appointment, gift, grant, bargain, sale, demise, mortgage,

Settlement, or to prejudice any person or persons having any right or claim of Dower, Jointure, Portion, Debts, Rents, or Incumbrances out of or upon or affecting any of the Messuages, Buildings, Lands, or Grounds to be divided, allotted, and exchanged as aforesaid or any part or parts thereof respectively, but that the respective persons to whom any Lands or Hereditaments should be allotted or given in exchange by virtue of the said Act should be seized thereof to such and the same uses and for such and the same estates, and subject to such and the same Wills, Jointures, Rents, Charges, and Incumbrances, and no other as the Messuages, Buildings, Lands, Grounds, and Hereditaments whereof such person was seized or possessed at or immediately before the execution of the award to be made by the said Commissioners or for which or in respect whereof such Allot- inents and Exchanges should be made would have been subject to, charged with, or affected by, in case the said Act had not been passed.

awarded to Proprietors in respect of their Ancient Estates within the said Manor of Golcar, shall be accepted by the several persons to whom the same are respectively awarded as aforesaid, their Heirs, Executors,Administrators, Successors and Assigns, within two Calendar Months from the date and execution hereof, and that the same shall be accepted by them in full of their respective Rights and Interests in the Commons, Moors, and Waste Grounds, by the said second herein- before recited Act directed to be divided and inclosed or exchanged, and as a Compensation for all Ancient Inclosed Land or Ground taken by us for the widening of any road or roads within the said Manor or Tewnship of Golear aforesaid. And we do award the same accordingly and direct that the whole of the said Allotments shall be held and enjoyed by the respective parties or persons to whom the same are so awarded, and their respective Heirs, Executors, Administrators, Successors, and Assigns, according to their respective Estates and Interests, and upon and for the like Uses, Trusts, Ends, Intents and Purposes, such Parties or Persons were or are severally and respectively seized or possessed of and in the said Lands and Tenements in respect whereof the same are so awarded and allotted and that from and after the date and execution hereof all Rights of Common, Average, and Pasture of what nature or kind soever in, over, or

Provided tbat all such Exchanges be ascertained, specified, and declared in the award of the said Commissioners and be made with the consent of the Owner or Owners, Proprietor or Proprietors of the Lands, Tenements, or Here- ditaments which should be so exchanged whether such Owner or Owners, Proprietor or Proprietors should be a Body or Bodies, Politic, Corporate, or Collegiate, or a Tenant or Tenants in fee simple or tor life, or in fee tail, general or special, or by the Courtesy of England, or for years determin- able on any life or lives by and with the Consent of the Lessor or Lessors and not otherwise, or with the Consent of the Guardians, ‘Trustees, Feoffees for charitable or other uses, Husbands, Committees, or Attorneys of or acting for any such Proprietors or Owners as aforesaid who at the time of making such Exchange or Exchanges should be respectively Infants, Femme-Covert, Lunatics, or under any other legal disability, or who should be bevond the Seas, or otherwise disabled to act for themselves, himself, or herself, such Consent to be testified in Writing under the Common Seal of the Body Politic, Corporate, or Collegiate, and under the Hands of the other consenting Parties respectively, and all and every such Exchange and Exchanges so to be made should be good, valid, and effectual in the Law to all intents and purposes whatsoever.

PROVIDED always that no Exchange should be made of any Lands, Tenements, or Hereditaments held in respect of any Church, Chapel, or other Ecclesiastical Benefice, without the Consent testi- fied as aforesaid of the Patron thereof, and of the Bishop of the Diocese in which such Lands, Tenements, or Hereditaments so to be exchanged should lie or be situate.
